Here are the Terms & Conditions set forward by the developers of this Luxury Apartments building concerning the Allotment of an Apartment:

1. NAME AND LOCAT10N OF THE PROJECT.
Savoy Residences is located on Plot number 19, Sector F-11/1, Islamabad.

2. TERMS OF OFFERS.
Apartments are offered on ownership basis.

3. REGISTRATION AND ALLOTMENT.
Application for allotment shall be on the prescribed form included in the technical data and terms and Conditions including the name shall be read as an integral part of the terms and conditions for the "Sale of Apartment". Note; All applications shall be accompanied with the photocopy of national identity card/ passport; however Savoy Residences reserves the right to accept or reject any application for allocation of apartment without assigning any reason.

4. PRICING.
The price of each apartment is fixed, subject to change for circumstances beyond the control of the Savoy Residences which may include closure of the project beyond 3 months or stoppage of construction work for long intervals due to any; civil commotion, strike, natural calamity, war, change in fiscally policy by the Government of Pakistan. Any un-expected increase in the price shall be kept to the minimum by the Savoy Residences and it will further ensure that Apartment owner gets maximum possible relief.

5. CONFIRMATION OF PURCHASE OF APARTMENT.
Savoy Residences will confirm the purchase and allocate the apartment only on receipt of 50% of the sale price after which a “Provisional Allotment Letter” will be issued.

6. PAYMENT OF INSTALMENTS.
The purchaser shall pay the instalment as per the payment schedule within 10 days of the due date failing which the purchaser shall pay Rs.500/- per day as penalty to be calculated w.e.f. the date on which actual payment fell due (or as revised from time to time ) . NOTE: In the event of purchaser failing to pay the instalment along with penalty thereon, the Savoy Residences reserve the right to cancel the Registration / Withdraw the Provisional Allotment and offer the Apartment for sale to any intended buyer or purchase the same themselves; in any eventuality the amount deposited shall be refunded upon receipt of the sale consideration. 10% will be charged for the services rendered.

7. CONSTRUCTION AND SPECIFICATION.
The building shall be constructed according to the plans and specifications by CDA.
8. PROGRESS OF WORK.
The Savoy Residences shall maintain steady progress of work according to plans. The Savoy Residences however, shall not be responsible for any delay in completion if the payment schedule is disrupted or suspended by the purchaser.

9. TRANSFER OF OWNERSHIP.
The transfer of ownership of an apartment shall be executed in the favour of purchaser after the purchaser has paid the total sale consideration and has deposited the requisite Documentation Charges, Registration Fee and all other Legal Expenses, etc.

10. COMPLETION OF THE PROJECT.
The project is likely to be completed within two years and six months at the end of which physical possession of above apartment shall be handed over. To cater for any un-foreseen circumstances, Management reserves the right to make appropriate changes/adjustments in the final date of hand over of the apartment, if deemed necessary.

11. POSSESSION.
The purchaser shall take over possession of the apartment within 15 days of the receipt of the intimation letter from the Savoy Residences. In case of delay in taking over the possession of the apartment the Savoy Residences shall charge a fee of Rs. 5000/ per month as service charges.

12. SALE OF THE APARTMENT BY PURCHASER.
The purchaser shall not transfer or sell the apartment to a third party without prior written permission of the Savoy Residences. The Savoy Residences may allow such transfer on receipt of payment of all outstanding dues and a transfer fee of Rs.10,000/-. In such an eventuality the new purchaser shall be bound by all the terms and conditions set herein by the Savoy Residences.

13. TERMINATION 0F SALE BY PURCHASER.
In case of termination of the sale agreement, the Savoy Residences will refund the purchaser the amount deposited. The Savoy Residences shall deduct 10% (Ten percent) of the total amount deposited as service charge and refund the amount after the apartment had been re-sold.

14. DOCUMENTATION CHARGES.
The purchaser shall pay in addition to the price of the apartment, all documentation charges and any other charges which the Savoy Residences may incur as a pre requisite to the transfer of the apartment in various departments. All expenses shall be paid by the purchaser in cash on demand without any fail or delay. Any financial loss directly associated from the delay on part of the purchaser shall be paid to the Savoy Residences to complete all the formalities for the sub-lease etc. 
NOTE: The charges for the above mentioned purposes shall be determined by the Savoy Residences.

15. TAXES.
The purchaser shall be responsible for the payment of all taxes and levies as may be imposed by the Government of Pakistan w.e.f. the taking over of the physical possession of the apartment.
16.MORTGAGE FACILITY.
Loan/Mortgage facility for the housing finance if required shall be finalized strictly between the client and financial institution. Management shall facilitate arrangements for the provision of housing finance to allottees, however, it shall have no active role, responsibility or obligation in this regard.

17. MAINTENANCE.
The purchaser shall pay in advance maintenance and service charges of at least 12 months to the Savoy Residences as prescribed in the schedule of payment for onward payments to various departments, Salaries of Maintenance Staff, Security Guards, Electricians, Gardeners, Cleaners, etc. employed by the Savoy Residences for the proper upkeep of the project. All payments made under the head shall be verifiable.

18. RESIDENTS COMMITTEE FOR MAINTENANCE.
The maintenance of the services and amenities at the project will be finally looked after by the purchasers themselves who would form a Residents’ Committee to handle the affairs of the project. The committee will be formed after all apartments have been occupied.
19. ARBITRATION.
Arbitration shall be a precondition to any legal action. All disputes between the builders and the purchaser relating to the apartment shall, at first, be mutually settled by appointing one person each to represent each party. Both the representative shall appoint an umpire. The Arbitration shall be concluded within 15 days of any issue arising. Both parties are to bear their own costs however the failing party is to pay the cost of the Umpire. The decision of the Umpire shall be final and binding on both parties.

20. ORDERS AND INSTRUCTIONS OF CDA.
The purchaser shall undertakes the orders and instructions of CDA from time to time, shall be followed strictly. 
The purchaser shall comply with and abide by the rules, regulations, by-laws, orders or directions that may have been in force or may come into force at a later stage. The allottee shall have proportionate rights of lease in the land of flat site. Common spaces, basement and ancillary structures. The land is on 99 years lease from CDA and there will be no requirement of its renewal before 99 years. 
Annual ground rent/property tax charged by the CDA will be distributed according to the covered area of each apartment.

21. UTILITY CHARGES.
The purchaser will in addition to the above pay separately documentation charges for lease/registration charges relating to Sui gas, electric and water connections and all the miscellaneous expenses, which may be incurred by the developer in fulfilling formalities of various services, departments or agencies on actuals.

22. USE OF THE APARTMENTS-RESIDENTIAL PURPOSE.
The purchaser will use the premises for residential purposes only, and in addition thereto shall not bring inside the building any goods that are hazardous. The purchaser shall not make any internal or external additions, alterations or modifications without written approval of the Savoy Residences. Any illegal use of the apartment shall entail the consequence of cancellation of the apartment with right of the Savoy Residences to take over the possession upon payment of the price.

23. PAYMENTS.
All payments shall be made by the purchaser either by cash or by Cheque / Bank Draft in the name of Savoy Residences.

24. LOCATION OF PARKING.
Savoy Residences will decide the location of parking area for each apartment. The purchaser shall be bound to follow the instructions issued by the Management regarding use of parking spaces, passages, elevators, landscapes, common spaces and other facilities.

25. STORE AND SERVANT ACCOMMODATION.
Store will be provided inside the apartment and servant accommodation adjacent to the apartment except for 2 bed apartments where the servant accommodation has been provided in another area upon additional payment. The roof shall be the exclusive property of the Savoy Residences access thereto shall only be with the express written permission of the Savoy Residences.

26. PURCHASER’S RESPONSIBILITY.
The Purchaser binds him / her self unconditionally and undertakes to abide by the terms and Conditions, along with the terms and conditions of the Application and any alteration to the same by the Savoy Residences for the Betterment of the purchaser(s) in general. 
The purchaser shall not carry out any additions or alterations involving structures of the buildings within the allotted premises (the structure includes columns, slabs and beams) nor shall change the present elevation of the building or any part thereof under any circumstances. 
The property rights of the exterior walls of the building rest with Savoy Residences. To avoid different types of color shades and designs on the outside walls of the building, there will be no permission to change the color scheme of the exterior walls. Similarly, no projections / hooks / nails etc. will be allowed to be constructed / fixed on the outside and the common area walls of the buildings. 
Open spaces and corridors in the project shall not be converted nor utilized/rented out but will be used exclusively for the benefits of the purchasers/residents of the apartment.

27. SELLERS RIGHTS.
The Savoy Residences reserves the right to accept or reject any application for allocation of apartment without assigning any reason. The developers have the right to construct additional floor. The roof rights shall be the sole property of the developer. Management reserves the right to make appropriate changes/adjustments in final design of condominium, if deemed necessary.

28. UNDERTAKING.
The purchaser executes an undertaking that the terms and conditions have been read thoroughly and fully understood.
